In 2001, convicted serial rapist and murderer Matias Reyes was serving a life sentence in New York state. He had never been identified as a suspect in the Central Park attack on Meili, although he had been at large at the time.[77] Reyes was believed to have raped another woman in the same area of the park during the day on April 17, two days before the attack on Meili. Initially the Meili case was investigated as a homicide, and the April 17 rape was investigated as a rape assault, which resulted in a lack of comparison of the DNA recovered in the two cases.[78] The NYPD did not have a DNA database until 1994; after that, detectives and prosecutors had access to common information about DNA from evidence and taken from suspects in certain crimes.[78] During the summer of 1989, Reyes raped four more women, killing one, and was interrupted after robbing a fifth.[7]

In its January 2003 Armstrong Report, the panel "did not dispute the legal necessity of setting aside the convictions of the five defendants based on the new DNA evidence that Mr. Reyes had raped the jogger."[103] But it disputed acceptance of Reyes's claim that he alone had raped the jogger.[103][104] It said there was "nothing but his uncorroborated word" that he acted alone.[103] Armstrong said the panel believed "the word of a serial rapist killer is not something to be heavily relied upon."[103]
Jake Tyler Brigance: [in his summation, talking about Tonya Hailey] I want to tell you a story. I'm going to ask you all to close your eyes while I tell you the story. I want you to listen to me. I want you to listen to yourselves. Go ahead. Close your eyes, please. This is a story about a little girl walking home from the grocery store one sunny afternoon. I want you to picture this little girl. Suddenly a truck races up. Two men jump out and grab her. They drag her into a nearby field and they tie her up and they rip her clothes from her body. Now they climb on. First one, then the other, raping her, shattering everything innocent and pure with a vicious thrust in a fog of drunken breath and sweat. And when they're done, after they've killed her tiny womb, murdered any chance for her to have children, to have life beyond her own, they decide to use her for target practice. They start throwing full beer cans at her. They throw them so hard that it tears the flesh all the way to her bones. Then they urinate on her. Now comes the hanging. They have a rope. They tie a noose. Imagine the noose going tight around her neck and with a sudden blinding jerk she's pulled into the air and her feet and legs go kicking. They don't find the ground. The hanging branch isn't strong enough. It snaps and she falls back to the earth. So they pick her up, throw her in the back of the truck and drive out to Foggy Creek Bridge. Pitch her over the edge. And she drops some thirty feet down to the creek bottom below. Can you see her? Her raped, beaten, broken body soaked in their urine, soaked in their semen, soaked in her blood, left to die. Can you see her? I want you to picture that little girl. Now imagine she's white.
Postpartum depression (also known as post-natal depression) is recognized in some countries as a mitigating factor in cases of infanticide. According to Susan Friedman, "Two dozen nations have infanticide laws that decrease the penalty for mothers who kill their children of up to one year of age. The United States does not have such a law, but mentally ill mothers may plead not guilty by reason of insanity."[43] In the law of the Republic of Ireland, infanticide was made a separate crime from murder in 1949, applicable for the mother of a baby under one year old where "the balance of her mind was disturbed by reason of her not having fully recovered from the effect of giving birth to the child or by reason of the effect of lactation consequent upon the birth of the child".[44] Since independence, death sentences for murder in such cases had always been commuted;[45] the new act was intended "to eliminate all the terrible ritual of the black cap and the solemn words of the judge pronouncing sentence of death in those cases ... where it is clear to the Court and to everybody, except perhaps the unfortunate accused, that the sentence will never be carried out."[46] In Russia, murder of a newborn child by the mother has been a separate crime since 1996.[47]
